Needs for pupils

Overview

Depending on the type of school, students receive the following monthly requirements:

  • Pupils from vocational schools and technical colleges, whose attendance does not require a completed vocational training: 212 Euro.
  • Pupils from evening schools, vocational colleges, evening schools, and specialist high school classes whose attendance requires a completed vocational training: 383 Euro.
  • Pupils from secondary general schools and vocational schools, as well as from specialist and technical colleges whose attendance does not require a completed vocational training and who do not live with their parents: 383 Euro,
  • Pupils from evening schools, vocational colleges, evening schools, and specialist high school classes, whose attendance requires a completed vocational training and who do not live with their parents: 459 Euro.

As far as rental costs for accommodation and incidental expenses prove to exceed 57 Euro, the demand for paragraph 2 increases by up to monthly 72 Euro. In the case of an apprenticeship abroad, pupils from grammar schools and vocational schools are provided with travel expenses during a school year for two return trips. Travel expenses are 250 Euro for a trip within Europe, otherwise 500 Euro.

An apprentice also lives with his parents if the room he or she lives in is owned by the parents.

Need for students

Overview

Students can receive a maximum of

  • When attending a vocational school, whose attendance requires a completed vocational training, evening gymnasiums and colleges: 341 Euro.
  • If you attend a secondary school, academy and higher education: 366 Euro.

These sums are each increased by grants to the accommodation, if the trainee lives with his parents, monthly 48 Euro, if he does not live with his parents, by monthly 146 Euro. If the rental costs are demonstrably higher, you can still receive a grant a maximum of 72 Euro. Even when the study abroad takes place, grants are possible.

The preliminary ruling

Unfortunately, you can start the BAföG application once you have already started your studies. This is a disadvantage if you make the admission of another study section dependent on whether or not you get BAföG.

But you do not have to fumble in the dark: If you are not sure whether you can get BAföG at all, you should ask before the start of the study application for a preliminary ruling under BAföG 46,5 sentence 1 No. 2.

This clarifies whether your training is fundamentally supportive. You can apply for a preliminary ruling for each BAföG grant: According to the case law, BAföG § 46,5 Satz 1 Nr. 2 BAföG also permits a preliminary ruling in the event of a further training in accordance with BAföG § 7,2 BAföG , but an additional training within the framework of the basic claim according to BAföG § 7,1 (BVerwG, judgment of 23.02.1994, Az. 11 C 55.92).

Which office is responsible

Overview

The Office, which is responsible for the preliminary ruling, is responsible for deciding on the application for training. If the specified subject area of ​​the admission is subject to a central or regional award procedure and the training center can not be designated in a definite way, the competence of the office is determined by the apprentice's first location preference.

In the case of a positive decision, the trainee obtains a secured legal position, since the decision applies to the entire training section. The nature and amount of the benefit are not covered by the reference for a preliminary ruling. This can only be decided upon at the beginning of the training. The Office is no longer bound by the decision if the trainee does not begin the training within one year of the application.
