Since the 18. June 2007 is Amazon.de apparently no longer willing, to sit on the costs for the A up z guarantee applications, because since it is according to fixed at Amazon.de, which have not been preserved products - which are, can you find here. The question, These requirements are as binding, I am raising further bottom again on.
Is the seller regresspflichtig?
I started yet, me to complain with all objections at Amazon.de, that would have passed to the buyer, If this would have taken the warranty from Amazon.de unused and ceded his rights not to Amazon.de.
However I had to deal me now exclusively with Amazon.de and no longer with the buyer - what is hardly has simplified the thing.
What arguments are there?
An argument of mine: Amazon.de has the guarantee the purchaser already “on first shout out” granted, without more detail to verify, whether there is ever a legal right.
Therefore you have no opportunity to the timely rectification (zB. through once again sending) given, Although I repeatedly have offered the purchaser and then Amazon.de and which the law envisaged expiry for the assertion of lack of is not observed.
What says Amazon?
The counter argument from Amazon.de in an email of the press office was:
"In this case, the A-up-z guarantee attacks and we can offer unfortunately no replacement", "If the customer for fulfilment of the guarantee is."
Who shall bear the shipping costs?
Another argument: I summoned me to § 447 Civil Code, according to which the buyer under certain conditions - and were certainly given according to a lawyer – the shipping risk shall.
Because the Civil Code foresees no obligation for non-commercial provider, the shipping risk to wear, dh. without regard to fault of their own replacement for not-coming programmes. For this I would have to prove only, that I have the show properly packaged and shipped.
Requires an insured shipping?
For Amazon.de, however this proof considered to be provided, If the shipment insured - sent a staffer told me by phone. And only if I would have shown this, that I've really sent my book (and this would have written, asked to give an opinion for me Amazon.de), would you let at Amazon.de with it.
Though: Legally, an insured shipping would not necessarily require, to prove, that you actually sent the book. It would also be possible, to lead the evidence by witnesses or documents of switched transport companies.

Die Kommunikation mit Amazon scheint ähnlich einseitig zu sein, wie die Kommunikation mit ebay und paypal, die ja angeblich verloren gegangene Ware ebenfalls dem Käufer ungeprüft erstatten. Aus diesem Grunde nutze ich paypal nicht mehr und versende (auf Kosten des Käufers) grundsätzlich versichert.
Das muss allerdings auch im Angebot so beschrieben sein.

And. Amazon sitzt ja auch im Ausland. Gute Methode, die du da hast. Bei Ebay geht das auch gut. Das Problem bei Amazon: Man muss so automatisch einen höheren Preis angeben, da das aber in der Übersicht bei Amazon nicht extra ausgewiesen wird. D.h. Amazon zwingt so seine Marketplace-Verkäufer praktisch zu unversichertem Versand, weil man sonst gar nichts verkauft. Die Differenzierung Versandkosten/Preis kann man bei Amazon schlicht nicht machen, weil die einfach pauschal drei Euro für den Versand berechnen, die aber die versicherte Sendung nicht abdecken. Es in die Artikelbeschreibung zu schreiben bringt nichts, die liest ja keiner. Und am Ende sind die Käufer, die das in der Mehrzahl nicht verstehen, dann einfach sauer.
Unschön alles.
Nur wie schon geschrieben: Für Bücher ist Amazon einfach der bessere Marktplatz.
